Invention promotion companies or invention promoters is any entity who offers to perform invention promotion services for a customer and who holds itself out through advertising as providing such services unless the entity is a nonprofit, evaluates previously filed nonprovisional utility patent applications, participating in a sale of business or directly engages in the retail sales or distribution of products. 35 U.S.C. §297(c).
