“Food and drink patents” is an enormous category. You can patent an ingredient, preservative, supplement, substitute, cooking or manufacturing process, utensil, packaging, dispensing device, or accessory. It’s even possible (though extremely difficult) to patent a recipe. Because the food and beverage industries are notoriously full of knock-off producers, your patent will need to be exhaustively researched and meticulously prepared by a patent attorney with experience in the culinary space.
As an Orange County-based patent attorney since 2004 and an engineer before then, I have helped food beverage innovators apply for and be granted many patents. A few examples of culinary patents my clients have been granted include:
- A squeezable leak-proof feeding bottle that uses a one-way valve to minimize spills
- A way to make hot-drink mixes dissolve more quickly
- An eco-friendly coffee maker that can mix in other fluids with the coffee before it is dispensed
